Maina: Court Grants Bail To Ndume

The Federal High Court in Abuja has granted bail to the Borno South Senator, Ali Ndume, who has been detained in prison since Monday over his suretyship for Abdulrasheed Maina believed to have jumped bail.

Justice Okon Abang in a ruling on Friday said he chose to grant the senator bail based on his record of good behaviour before the court, notwithstanding that the other grounds of his bail application failed.

The judge granted bail to the senator pending the hearing and determination of Ndume’s appeal filed at the Court of Appeal to challenge Monday’s order sending him to jail for his inability to produce the fleeing Maina.

He ordered the senator to produce one surety who must be a resident of Abuja and present evidence of ownership of property anywhere in Abuja.

According to the judge, the surety must also depose to an affidavit of means to indicate his readiness to forfeit the bail guaranty should the senator jump bail.

The judge also ordered the senator to deposit his passport with the Chief Registrar of the court.

He also ordered the lawmaker to file an undertaking that he would compile records of appeal and transmit it to the Court of Appeal within 10 days, a way the court wants him to demonstrate his readiness to prosecute his appeal.

Maina, a former Chairman of the defunct Pension Reformed Task Team, Abdulrasheed Maina, is being prosecuted by the EFCC on charges of money laundering involving N2bn.

On November 18, 2020, Justice Abang revoked the bail granted him, ordered his arrest, and directed that his trial would proceed in absentia.

The judge also on Monday remanded Ndume in prison until he produced Maina or paid the sum of N500m bail bond to the Federation Account.

Ndume, through his lawyer, Marcel Oru, had on Tuesday filed an appeal against the remand order at the Court of Appeal, along with an application for the bail of the defendant filed before Justice Abang.

HISBAH Board Bans "Black Friday" In Kano, Writes 96.9 Cool FM Radio Station

Hisbah bars radio station from saying ‘Black Friday’

The Kano State Hisbah Board, which is tasked with the duty of enforcing Sharia law in Kano State, has written a letter to a radio station, in Kano State, 96.9 Cool FM, for using the term ‘Black Friday’.

Black Friday is an informal name for the Friday following Thanksgiving Day in the United States, which is celebrated on the fourth Thursday of November. The term is used worldwide to mean a day for promotional sales where goods are sold at discounted prices.

However, in a letter signed by Principal Executive Officer II, Abubakar Ali, on behalf of the Commander-General, Hisbah stated that Friday is regarded as a holy day in Islam and tagging it as ‘black’ is derogatory and would not be condoned.

The letter titled, ‘Letter of Introduction’ reads in part, “I am directed to write and notify you that the office is in receipt of a complaint for the conduct of ‘Black Friday Sales’ on November 27, 2020.

“Accordingly, we wish to express our concern on the tagging of Friday as ‘Black Friday’ and further inform you that the majority of the inhabitants of Kano State are Muslims that consider Friday as a holy day.

“In view of the foregoing, you are requested to stop calling the day ‘Black Friday’ with immediate effect and note that the Hisbah Corps will be around for surveillance purposes with a view to avoiding occurrence of any immoral activities as well as maintaining peace, harmony and stability in the state.”

Hisbah, an Islamic police operating in many states in the North, has been accused of several human rights abuses.

It is known for accosting vehicles transporting alcoholic beverages and does not allow such vehicles to pass through the state. Hisbah’s Commander General, Sheik Aminu Daurawa, had said over 12 million bottles of beer were destroyed in 800 operations executed in seven years.

According to the National Broadcasting Commission Act, only the NBC has the power to sanction a radio station especially in matters that relate to broadcasting.

Five Men Inscribe '50K' On Teenager After Raping Her In Enugu

A man, identified as Okwudili, a shop owner at Proda junction in Enugu State, has been accused of kidnapping, torturing and gang-raping a 16-year old girl in connivance with four alleged cult members.

Okwudili and his accomplices reportedly inscribed N50,000 on the back of the victim and left her unconscious in remote farmland in the state before they reluctantly invited the victim's sister, Prisca Eze, to pick up her sibling.

In two petitions to the commissioner of police in Enugu State, Ahmed Abdulrahman, SaharaReporters learned that the victim was an apprentice to a fruit seller close to Okwudili's shop.

"On Friday, November 6, Mr Okwudili was going out early in the afternoon and handed his shop key to the victim and asked her to help him look after his shop," the petition signed by the Rule of Law Accountability and Advocacy Centre (RULAAC) read.

"Mr. Okwudili did not come back as at 6 p.m. when Goodness was ready to close work and go home."

According to the letter to Abdulrahman, the victim traced Okwudili's wife and handed the key to her before going home.

When the victim returned to work on Monday, Okwudili accused her of stealing recharge cards worth N50,000 from his shop.

He then went on to invite the four cult boys who beat up the girl in the stall where she was

Unsatisfied with their day's work, the boys who were reportedly armed with guns took the victim to her house and continued the beating in the presence of her sister.

"When she – Mrs Eze asked them to stop beating her sister, they pulled their guns and threatened her," the petition pointed out.

Powerless to do anything, Eze watched helplessly as her sister was taken away by the cultists and Okwudili.

The petitioner said she searched for her sister from Monday morning up until 5 p.m. when she succeeded in obtaining Okwudili's number.

When she called the mastermind, "he asked her to come to Ituku Emene for her sister."

"Mrs Eze said she went to Ituku village with her husband and when they saw Okwudili, he took them to a farmland where he showed them Goodness lying unconscious in a pool of blood with injuries all over her body," the petition read.

"She and her husband took Goodness to a hospital where, after she had regained consciousness; she narrated to them how Okwudili and the four young cult members gang-raped her and used a knife to inscribe 50K on her back."

The initial petition seeking justice for the victim was written by the president, Civil Rights Realisation and Advancement Network, Olu Omotayo.

When SaharaReporters spoke to him, he said he had received only a single call from the police on the matter and the investigation had yet to commence despite a second complaint from RULAAC.

"After I heard what happened to the girl from a pastor who knows I'm into human rights, I went to the hospital, saw the girl and wrote a petition to the CP – Abdulrahman," Omotayo said.

"A policewoman called me a few days later and said the CP saw my petition and asked the area commander to investigate the case."

Omotayo said the police had developed cold feet on getting justice for the victim, due to pressure from Prisca Eze's husband, Ejike.

"Ejike has been compromised according to what I gathered from the policewoman," he said. "He was not helpful to the policewoman.

"I told the woman that even if the husband – Ejike is not cooperating, you can talk to the girl and her sister and find out where the suspect lives. I think he has a shop close to where the victim works."

When SaharaReporters spoke to Pastor Onyekachi Chukwu, the man who brought the human rights lawyer into the picture, he said Ejike had been threatening to evict his wife and her sister if the case was not dropped.

"The husband is saying that if the case moves on, he will sack the wife and the sister, and they don't have anywhere to go," the pastor said.

WHAT DID SECTION 230 SAY?

Section 230 is a piece of Internet legislation in the United States, passed into law as part of the Communications Decency Act (CDA) of 1996 (a common name for Title V of the Telecommunications Act of 1996), formally codified as Section 230 of the Communications Act of 1934 at 47 U.S.C. § 230.[a] Section 230 generally provides immunity for website publishers from third-party content.

At its core, Section 230(c)(1) provides immunity from liability for providers and users of an "interactive computer service" who publish information provided by third-party users:

No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider.

The statute in Section 230(c)(2) further provides "Good Samaritan" protection from civil liability for operators of interactive computer services in the removal or moderation of third-party material they deem obscene or offensive, even of constitutionally protected speech, as long as it is done in good faith.

Nigeria May Lose $493m Paid To Procure Fighter Jets —senate 

The Senate Committee on Airforce, said on Thursday that Nigeria stood the risk of losing $493m paid to the United States for the purchase of Super Tucano fighter planes.

The panel said the nation’s runway at the moment was not up to the standard and could not carry the fighter jets.

The Federal Government had wired in $493m in 2018 to a US company to tackle insurgency and other security challenges facing the country.

The Vice-Chairman of the Senate Committee on Air Force, Senator Mike Nnachi, raised the alarm while presenting the 2021 budget report of the Air Force before the Senate Committee on Appropriation.

He told the lawmakers that when the Americans came to inspect the Kanji runway, recently, they complained that the facility did not have the capacity to carry the aircraft.

He, therefore, said there was the need to make provision for additional N9bn that would take care of the runway and aircraft or else Nigeria will lose the money and the aircraft.

Nnachi said, “It is a very serious issue, the Airforce personnel are running around. They have gone to the Finance Minister. They have also gone to the Central Bank of Nigeria, and they have gone to meet the Senate President because the money needed was not part of the main budget.

“Jack Must Pay” – Adamu Garba Explains His Absence In Court Against Twitter CEO 

Adamu Garba, a former presidential aspirant under the All Progressives Congress, APC, has explained why he and his team were absent at the hearing of his suit filed against the founder and CEO of Twitter, Jack Dorsey.

Adamu Garba said that his lawyers received the notice for the hearing late hence why they requested for an adjournment, IgbereTV reports.

Recall that Tope Akinyode, a Nigerian rights lawyer who filed a lawsuit challenging the criminal complaint administered by former Presidential aspirant, Adamu Garba against CEO of Twitter, Jack Dorsey, said Garba and his lawyer’s failed to show up for hearing at the Federal High Court on Wednesday, November 25, 2020.

Speaking on his decision to not appear, Garba took to his Twitter account to reveal the reasons, while also stating that his team will pursue the case to the end.

The Students Union Government of The Federal Polytechnic Offa in celebration of SUG week has given out number of gifts to celebrate academic excellence among the contestants that registered for quiz and spelling bee competition.

The Students' Union leader, Abiola Azeez Adigun who described the gifts as attempt to encourage students with sound academic knowledge and those who are socially and legally responsible.

He said: "This year's SUG week is not only about socialization, it includes meritorious awards in relation to academic activities. We organized spelling bee and quiz competition where the winner and the runner-ups are to go home with washing machine, home theatre system and kitchen materials."

He however reacted to the fake awards that are being circulated on social media. He tagged it as one that is targeted at soiling the reputation of the Students' Union and the Polytechnic. He added that the awards are being produced by mischief makers to destroy the hard work his administration has already put in place.

"The awards that are being displayed on social media are purely produced by the enemies of progress. We are shocked that people can go to that extent to bring us down. But God is over everything and our good works so far as Union Executives have inundated us. In our institution, our tenet and legacy is academic excellence and that is what we always celebrate. Any award from us devoid of academic excellence moral uprightness and legal social responsibility are fabricated," he added.

Recalled that the Students' Union leader of the Federal Polytechnic Offa won the outstanding President award among all the Polytechnic SUG Presidents by National Association of Polytechnic Students (NAPS). 

Comrade Adigun further proclaimed his continuous efforts to move the Union forward in the interest of the students without minding the mischief makers trying to disorganise his administration with malicious contents and fabrications.

Tinubu Has The Vision, Political Sagacity To Move Nigeria Forward – APC

Lagos – Ahead of the 2023 presidential election, Lagos State chapter of the All Progressives Congress (APC), has said that Asiwaju Bola Tinubu, national leader of the party, has the vision and political sagacity to move Nigeria forward.

Alhaji Tunde Balogun, the State Chairman of the party, also rejected the opinion by Alhaji Shettima Yerima, President of Arewa Youth Consultative Forum who said Tinubu, a two-term governor of Lagos state is “destined to be a kingmaker and not a king”, implying that Tinubu can install president but cannot become a president himself.

According to Yerima “People like him (Tinubu) are not needed in 2023. I see him as one of those elder statesmen who have made positive impacts in the lives of the younger generation. So, take it or leave it, he has done his best in raising younger leaders.

“But sometimes in life again, there are those who make kings but they themselves cannot be king. Probably it is his destiny. He can make kings but he cannot be king. But there is nothing wrong in that because you can be father to the king”.

Speaking in an interview with INDEPENDENT, Balogun said Shetimma only expressed an opinion which he is entitled to, adding that what he said about Tinubu is a not a fact.

He said Tinubu is one of the greatest political leaders in Africa and a leader with great foresight who has what it takes to move Nigeria forward.

“That is his own opinion, which is not a fact. Shetimma is entitled to his own opinion. No matter what anybody says, Asiwaju is one of the greatest political leaders in Africa. He is a phenomenal leader in Africa.

“His ability to spot and nurture leaders who have excelled not only in Lagos but across the continent is enough testimony that he is a tested leader with great foresight. He is a man that has the vision and the political sagacity to move this country forward.”
